Refund policy

1. General Provisions and Scope This Return, Refund, and Legal Guarantee Policy (the "Policy") governs all consumer purchases made via Szymon Duda Arameia (the "Store"). This Policy applies strictly to "Consumers"—defined as any natural person acting for purposes which are outside their trade, business, craft, or profession. This Policy is fully compliant with the Consumer Rights Directive 2011/83/EU and the Polish Act on Consumer Rights, ensuring uniform protection for consumers across the European Union (EU) and the European Economic Area (EEA).

2. Statutory Right of Withdrawal (Cooling-Off Period) As a Consumer residing within the EU or EEA, you possess the statutory right to withdraw from this contract without giving any reason within fourteen (14) calendar days.

  • The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

  • In the case of a contract relating to multiple goods ordered in one order and delivered separately, the withdrawal period expires 14 days from the day on which you acquire physical possession of the last good.

  • If the expiration of this period falls on a public holiday or weekend, the deadline is extended to the next working day.

3. Exercising the Right of Withdrawal 

To exercise your right of withdrawal, you must inform us (Szymon Duda Arameia, Sebastiana Klonowica 16/11, 20-442 Lublin, Poland, hello@arameia.com, +48 511 333 115) of your decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post or an email). You may use the Model Withdrawal Form in Section 10, but it is not obligatory.

To make this process as easy as possible, we provide digital withdrawal options directly on our website:

  • For Customers with a Store Account: You can log into your account, click the "Orders & Returns" link, select the relevant order, and click the digital withdrawal button next to each item to submit your request in just two clicks.

  • For Guest Buyers (No Account/No Login Required): If you checked out as a guest, you do not need to log in or create an account to exercise your rights. You can simply email us at hello@arameia.com with your name and order details, or use our contact form, and we will process your withdrawal manually.

Upon submitting your request (either via the "Orders & Returns" button or via email), we will immediately send you an automated confirmation of receipt on a durable medium (such as email). To meet the deadline, it is sufficient to send your communication before the 14-day withdrawal period has expired.

4. Effects of Withdrawal and Financial Mechanics If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us).

  • Refund Timeline: We will make the reimbursement without undue delay, and not later than 14 days from the day on which we are informed about your decision to withdraw. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

  • Payment Method: We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We do not charge any restocking or administrative fees.

  • Return Shipping Costs: You will have to bear the direct cost of returning the goods. The goods must be sent back to our facility at without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us.

5. Statutory Exemptions from the Right of Withdrawal The right of withdrawal does not apply to contracts for the supply of goods made to the consumer’s specifications or clearly personalized. Customized candles—including those with bespoke engraved glassware, specific requested scent profiles not in standard inventory, or personalized labels—cannot be returned under the 14-day statutory rule.

6. Diminished Value and Product Handling (Candle Specifics) 

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

  • Inspecting the Candle: You are fully entitled to open the shipping package, unpack the candle, and inspect its aesthetic properties and unlit fragrance (just as you would in a physical retail store). Opening or discarding the outer cardboard shipping box does not affect your right to return.

  • Lighting the Wick: Lighting the wick of the candle constitutes handling far beyond what is necessary to inspect the goods. Burning a candle destroys its commercial value entirely. If a burned candle is returned, a diminished value deduction of up to 100% of the purchase price will be applied to your refund.

  • Mandatory CLP Safety Labels: Scented candles contain chemical mixtures (fragrance oils) and are legally required under European law to carry mandatory Classification, Labelling, and Packaging (CLP) safety and hazard labels. These labels are affixed directly to the candle container (the glass or jar itself). If you peel off, deface, or destroy these mandatory safety labels, the product cannot legally be resold. A deduction for diminished value will be applied to cover the cost of restoring the label or the loss of the product's resale value.

7. Legal Guarantee of Conformity (Defective Goods) Independent of your right of withdrawal, we are under a statutory legal obligation to supply goods that are in conformity with the contract. We bear absolute liability for any lack of conformity (defects) which exists at the time the goods were delivered and which becomes apparent within two (2) years of that time.

If your candle is defective (e.g., shattered glass upon delivery, manufacturing defect in the wick, lack of conformity with the description), you have the right under Polish law ("niezgodność towaru z umową") to request:

  1. Replacement or Repair: We will replace the defective candle free of charge. (Given the nature of the product, repair is generally not feasible). We will cover all costs associated with the replacement, including shipping.

  2. Price Reduction or Full Refund: If replacement is impossible, involves disproportionate costs for us, or cannot be completed within a reasonable time without significant inconvenience to you, you may request a proportionate reduction in price or terminate the contract for a full refund.

To report a defective good, please contact us at hello@arameia.com with a description and photographic evidence of the defect.

8. Dispute Resolution (ADR) We aim to resolve all disputes amicably. If a formal complaint is rejected by us, we will inform you on a durable medium whether we agree to participate in Alternative Dispute Resolution (ADR) proceedings.

Consumers have the right to utilize out-of-court complaint and redress mechanisms. In Poland, disputes can be submitted to the Permanent Consumer Arbitration Courts (Stałe Polubowne Sądy Konsumenckie) operating at the Provincial Inspectorates of the Trade Inspection (Wojewódzki Inspektorat Inspekcji Handlowej - WIIH). Information regarding the competent entity for our business can be found at the WIIH Lublin website (www.ihlublin.pl), located at ul. Tomasza Zana 38 c, 20-601 Lublin.

(Notice: The European Commission's Online Dispute Resolution (ODR) platform was officially discontinued on July 20, 2025. All dispute resolutions must now utilize the competent national ADR bodies as described above).

9. Language and Governing Law While this contract is governed by Polish law, this choice of law does not deprive you of the protection afforded to you by provisions that cannot be derogated from by agreement by virtue of the law of the EEA country where you have your habitual residence.
